Manifestations of discrimination in the process of exercising one’s right to social security

Abstract

У статті досліджено прояви дискримінації у процесі реалізації особами свого права на соціальне забезпечення. Здійснено аналіз судової практики та визначено основні підстави звернення до суду. Встановлено, що основною формою дискримінації у сфері соціального забезпечення осіб є непряма дискримінація, яка найчастіше зустрічається у правовідносинах, що виникають із приводу пенсійного забезпечення та здійснення страхових виплат внутрішньо переміщеним особам, які постраждали внаслідок нещасного випадку на виробництві та професійного захворювання./ The article analyzes the manifestations of discrimination in the process of exercising one’s right to social security. The case law has been analyzed and the main reasons for applying to court have been identified. It has been established that the main form of discrimination in the field of social security is indirect discrimination, which is most common in the legal relations concerning the provision of pensions and insurance payments to internally displaced people having been harmed as a result of an accident at work and occupational disease.
