ІНСТИТУТ ОМБУДСМЕНА В ІЗРАЇЛІ ТА УКРАЇНІ: АДМІНІСТРАТИВНО-ПРАВОВЕ ДОСЛІДЖЕННЯ

dc.description.abstractДослідження присвячено аналізу особливостей адміністративно-правового статусу омбудсмена в Ізраїлі та Україні. Встановлено, що обидві правові системи врегульовують функціонування цього інституту на підставі положень міжнародних документів та національного законодавства. Доведено, що під час дії спеціальних правових режимів діяльність омбудсмена не обмежується, а навпаки, модернізується з урахуванням актуального стану суспільства та держави. Визначено, що попри окремі проблемні аспекти законодавчого закріплення адміністративно-правового статусу, означені інституції ефективно виконують свою правозахисну функцію. В обох державах призначення відповідної особи на посаду Державного контролера та Уповноваженого Верховної Ради України з прав людини відбувається за чіткою процедурою, що визначена нормами спеціального законодавства. Попри існуючі відмінності у правовому регулюванні, ізраїльська та українська судова практика неодноразово вирішує публічно-правові спори, де однією зі сторін є омбудсмен. З’ясовано, що такі судові рішення безпосередньо позначаються на подальшій реалізації омбудсменом своїх повноважень із додержанням принципів «доброго врядування» (good governance).
